Recent Experience Highlights

Client Story:  Voluntary Dismissal Obtained on Behalf of Pharmaceutical Company.

Where we started:  Plaintiff filed suit against a number of manufacturers alleging her use of Ciprofloxacin caused Achillies tendonitis and injuries to her feet and ankles. Our roadmap:  The depositions of the plaintiff and her treating physician were taken. It was established that plaintiff, a nurse, qualified as a sophisticated user of the product.  It was also proven plaintiff was allowed to self-diagnose and treat herself without proper oversight required by the product’s instructions for use.  She also failed to read the product literature. Evidence also established that the physician was a learned intermediary.  As such, we maintained a duty was only owed to him in order to comply with the Louisiana Products Liability Act.  He confirmed access to the product’s instructions for use and information contained within the Physician’s Desk Reference. At the close of discovery, various dispositive motions were filed on the issues of causation, product identification, and failure of plaintiff to use the product in a reasonably anticipated manner. Resolution: After filing the various motions, a voluntary dismissal was obtained.
