Louisiana Health Care Liability and Medical Defense Law Firm

Our firm represents Louisiana’s healthcare providers in defending medical malpractice claims and in administrative panel proceedings involving disciplinary actions, certification, licensing and regulatory compliance.  We help physicians, nurses, pharmacists, physical therapists and other medical and healthcare professionals and their employers and insurance carriers in trials and appeals involving contract disputes, as well as before the Louisiana State Board of Medical Examiners and other licensing boards.

We have years of experience with investigations, the medical review panel process and the defense of providers with license and compliance issues.  Our healthcare team which includes a lawyer who is also a Registered Nurse with a Certificate in Corporate Healthcare Compliance works collaboratively with clients throughout the state to obtain, protect and restore their Louisiana licenses.  Our lawyers also have experience litigating Scope of Practice issues on behalf of physician practices, including obtaining a permanent injunction that had national significance.

With many years of experience in this area of the law, Keogh Cox is well known and respected by Louisiana’s public healthcare agencies and professional boards.  Our rapport is an advantage in facilitating the timely resolution of cases.

Recent Experience Highlights

Client Story: Injunction against Louisiana State Board of Nursing on behalf of Pain Management Physicians

Where we started: The Louisiana State Board of Nursing expanded the scope of practice of Certified Registered Nurse Anesthetists (CRNAs) to include interventional pain procedures reserved to physicians.  Keogh Cox was retained by physicians to contest this scope of practice expansion.

Our roadmap: The litigation addressed unique issues in Louisiana law not previously addressed by the court system.  The litigation was protracted, involving a number of motions and appeals.

Resolution: After a two-day trial involving testimony from a number of experts,  Keogh Cox obtained a judgment finding that the Louisiana State Board of Nursing substantively expanded the scope of practice of CRNAs into an area where they had not traditionally practiced. The practice of interventional pain management was not within the CRNAs scope of practice, as the practice of pain management is solely the practice of medicine.  The trial judgment was affirmed on appeal on these issues.  The Louisiana Supreme Court denied writs.

Client Story: Defense of Disciplinary Matters

Where we started: Chad Sullivan, RN, JD, frequently defends nurses and other medical professionals before their respective boards for disciplinary matters.  Chad is a lawyer who is also a Registered Nurse with a Certificate in Corporate Healthcare Compliance.

Our roadmap: With over 14 years of practice in defending nurses and other healthcare providers in disciplinary matters, Chad is familiar with the rules and regulations of the healthcare boards.  As a result, he helps his clients reach cost effective resolutions to their board matters through settlement agreements and representation at administrative hearings.

Resolution: New disciplinary matters are often referred to Chad by his former clients.  Clients often continue to consult with Keogh Cox on other matters, maintaining an ongoing relationship.
